Is all under age sex statutory rape?

If a 20 year old man has sex with a 17 year old girl 5 minutes before her eighteenth birthday and finishes having sex 3 minutes after her birth day you:

- have him charged with statutory rape?
- let them have each other?
- say it's her choice?
- think, who cares, big deal?

Suppose the gender role were reversed?

No prosecutor in this country would take that case... if they did a judge would throw it out immediately, regardless of which one the man/girl was. Five minutes out from being legal would be a pointless case.
